You Won’t Believe What the US House Subcommittee Just Unveiled About Privacy and AI!

Privacy Legislation Must Come Before AI Regulations, U.S. Lawmakers Say

Lawmakers in the U.S. House Committee on Energy and Commerce have emphasized the need for comprehensive federal privacy legislation before meaningful regulations on artificial intelligence (AI) can be implemented. The committee held a dedicated AI hearing, during which witnesses highlighted the importance of privacy laws in protecting consumers from harmful data collection practices. The American Data Privacy and Protection Act (ADPPA) was repeatedly touted as a potential solution, with bipartisan support for the bill seen as a positive sign for future privacy and AI legislation. However, progress has been slow, with other matters delaying the passing of the ADPPA in Congress.

Privacy Issues Across the Aisle

Both Democrats and Republicans have expressed concerns over privacy and shown a willingness to support federal privacy legislation. The bipartisan momentum to develop privacy laws is seen as crucial for fostering innovation in AI technology while safeguarding individuals. Experts have argued that existing consent mechanisms are inadequate for protecting personal data, particularly as AI models become more sophisticated. AI Now Institute Executive Director Amba Kak and other witnesses stressed the need for clear rules and regulations to address the privacy harms caused by AI systems.

Privacy Standards Before AI-Specific Laws

While some witnesses called for the passing of AI-specific legislation alongside federal privacy laws, former Federal Trade Commission Chair Jon Leibowitz cautioned against the creation of a patchwork of state laws to tackle AI without a cohesive privacy framework. Leibowitz argued that a comprehensive AI law will likely be necessary in the future, but first, a privacy law must be enacted to provide a strong foundation. Several states have already enacted their own privacy laws due to the lack of a national standard. A federal privacy law could grant regulatory authorities like the FTC more power to address the negative impacts of faulty AI models on consumers.

Debating Impact Assessments for AI

Witnesses disagreed on the requirements for AI impact assessments. Congressman Jan Schakowsky highlighted the need for independent evaluations of new AI models to prevent biased and untested systems from making life-altering decisions. BSA President and CEO Victoria Espinel argued that while impact assessments were important, they should not be conducted by third-party auditors due to the lack of accreditation and standardized procedures. She advocated for internal assessments conducted by companies themselves to ensure responsible AI development.
